1. Identification
The Birds Jewellery online shop is operated by Ana Cristina Marques Pinto de Campos Pires, sole trader registered in Portugal, VAT no. 2. Scope
These Terms govern the purchase of products through this online shop. By placing an order, the customer confirms they have read and accepted these Terms, the Refund policy, the Shipping policy and the Privacy policy. Nothing in these Terms limits the rights granted to consumers by Portuguese law.
3. Orders and formation of the contract
The display of products in the shop is an invitation to treat. By submitting an order, the customer makes an offer to purchase. The contract is formed when the order confirmation e-mail is sent. We reserve the right not to accept orders in cases of product unavailability, manifest pricing error or suspected fraud; in such cases, any amount already paid is refunded in full.
4. Prices and payment
Prices are shown in euros and include VAT at the legal rate. Shipping costs, where applicable, are shown before checkout is completed. Available payment methods are those shown at checkout. The applicable price is the one in force at the time of the order. In the event of a manifest pricing error, we will inform the customer and offer the option to confirm the purchase at the correct price or cancel at no cost.
5. Shipping and delivery
Shipping conditions, times and costs are set out in the Shipping policy. Delivery times are estimates; if delivery is delayed by more than 30 days, the customer may terminate the contract and be refunded. Risk of loss or damage passes to the consumer when they, or a third party designated by them, take physical possession of the goods.
6. Right of withdrawal, returns and warranty
Consumers may withdraw from the contract within 14 days of receiving the order, without giving any reason, under Portuguese Decree-Law 24/2014. Products are covered by the 3-year legal conformity warranty (Decree-Law 84/2021). Procedures are set out in the Refund policy.
7. Products
Our pieces are handmade; small variations in colour, shine or bead arrangement are characteristic of the artisanal process and do not constitute defects. Colours shown on screen may vary slightly depending on the device used.
8. Intellectual property
The contents of this shop (texts, photographs, designs, the Birds Jewellery brand) are the property of the owner and protected by applicable law. Reproduction or use without prior written permission is not allowed.
9. Personal data
Personal data is processed in accordance with the Privacy policy and the General Data Protection Regulation.
10. Liability
We are liable for damages caused by breach of our obligations under the law. Nothing in these Terms excludes or limits our liability where the law does not allow it, nor does it affect consumers' statutory rights.
11. Complaints and alternative dispute resolution

In the event of a consumer dispute, the consumer may turn to CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt) or to another alternative dispute resolution body from the list available at www.consumidor.gov.pt.
12. Governing law and jurisdiction
Portuguese law applies. The courts of the consumer's place of residence have jurisdiction over any dispute, without prejudice to recourse to alternative dispute resolution.
13. Changes
We may update these Terms at any time. The version applicable to each order is the one published when the order is submitted.
